1. About these terms
These terms apply when you access the Waylance Business website, request a quotation, submit a booking request or communicate with us about vehicle hire. “Waylance”, “we”, “us” and “our” mean Waylance Business, ABN 96 763 818 295. “You” means the person using the website or requesting a quote or rental.
A confirmed hire is also governed by the rental agreement provided for that booking. If these website terms and a signed rental agreement are inconsistent, the signed rental agreement applies to the rental to the extent of the inconsistency.
2. Quotes and booking requests are not confirmations
A quotation is an estimate based on the information available when it is prepared. It does not reserve the vehicle, guarantee availability or create a rental. A quote may contain a validity period and may need to be revised if dates, availability, pricing, taxes, fees or your requirements change.
Submitting the online form creates a booking request only. It does not guarantee availability, reserve the vehicle or create a confirmed rental. A rental is confirmed only when Waylance approves the request, any required checks and payments are completed, and we issue confirmation or a rental agreement.
Continuing to booking with a quote number retrieves the relevant details to begin a booking request. It is still subject to current availability, driver eligibility, required payments and the rental agreement.
We may decline a request where the vehicle is unavailable, information cannot be verified, eligibility requirements are not met or we reasonably cannot provide the rental.
3. Information you provide
You must provide current, complete and accurate information. You must not submit information for another person unless you are authorised to do so. Tell us promptly if relevant information changes before pickup, including your contact details, licence status or travel requirements.
4. Driver eligibility
Every driver must hold a current and appropriate driver licence, satisfy the eligibility and insurance requirements disclosed for the rental, and provide information or evidence reasonably requested by Waylance. Only drivers named and approved in the rental agreement may drive the vehicle. Final eligibility requirements will be set out in the booking confirmation or rental agreement.
5. Availability, rental period and vehicle
Availability shown online is indicative and may change before confirmation. Pickup and return dates and times, total rental days, locations and the vehicle will be recorded in your confirmed rental details. You must return the vehicle at the agreed place and time unless we approve a change in advance.
Vehicle images and descriptions are provided to help identify the vehicle and its general features. Minor differences caused by maintenance, accessories or presentation do not change the agreed vehicle category or your obligations under the rental agreement.
6. Prices, payments and bonds
Applicable hire charges, bonds, payment dates, additional fees and accepted payment methods may be included in a quotation and will be confirmed before rental or in the rental agreement. You are responsible for amounts properly payable under the confirmed booking and rental agreement, including authorised extensions, damage, loss, cleaning, refuelling, tolls, infringements or other charges where applicable.
7. Cancellations and changes
Contact us promptly if you need to change or cancel a request. A request can be changed or withdrawn before confirmation, subject to availability. Once confirmed, the cancellation, amendment, late return and no-show terms disclosed in the booking confirmation or rental agreement apply. We will not impose a fee that has not been disclosed or is prohibited by law.
8. Vehicle use and care
During a confirmed rental, the vehicle must be used lawfully, safely and in accordance with the rental agreement. You must take reasonable care of it, follow operating and road-safety requirements, keep it secure and not allow an unauthorised driver to use it. Prohibited uses and any geographic or road restrictions will be stated in the rental agreement.
9. Incidents, damage, tolls and infringements
You must promptly notify Waylance of an accident, breakdown, damage, theft, warning light or other incident and follow reasonable instructions. Do not admit liability or arrange repairs without authorisation except where necessary for immediate safety. Responsibility for damage, loss, insurance excesses, tolls, fines and administration costs is determined by the rental agreement and applicable law.
10. Electronic quotations and agreements
We may use SignWell or another electronic document provider to prepare and send quotations and to prepare and sign rental documents. You consent to receiving documents electronically where you choose to continue through that process. You are responsible for reviewing the complete quotation and rental agreement, and for keeping copies for your records.
11. Privacy and licence information
We handle personal and driver licence information as described in our Privacy Policy. Use the secure licence step on our website when requested and do not include licence details in the optional booking message.
12. Website availability and acceptable use
You must not misuse the website, attempt unauthorised access, interfere with its operation, submit false or malicious data, or use automated tools in a way that places an unreasonable load on the service. We may suspend access to protect the website, customers or our systems. We aim to keep the website accurate and available but cannot promise uninterrupted or error-free access.
13. Intellectual property
Unless stated otherwise, website text, branding, layout and original materials belong to Waylance or are used with permission. You may view and print information for your personal booking purposes, but may not copy, publish or commercially exploit it without permission.
14. Consumer rights and liability
Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. To the extent permitted by law, Waylance is not liable for indirect or consequential loss arising only from website interruption, your failure to provide accurate information, or use of the website contrary to these terms.
15. Changes, governing law and contact
We may update these terms from time to time. The terms in effect when you submit an enquiry, quote request or booking request apply to that request, subject to any later rental agreement you accept. These terms are governed by the laws of New South Wales, Australia, and the parties submit to the courts with jurisdiction there.
